ABIDING TO RULES AND REGULATIONS, NO IMPORTATION AND RETAILING OF OVERSEAS NU SKIN PRODUCTS (2015.05)

Abiding to rules and regulations,
No importation and retailing of overseas NU SKIN products


Recommended by a friend, Nancy knew NU SKIN, and was deeply impressed by its quality products and excellent business and culture. She decided to full-time devote herself to NU SKIN business and start a new chapter of her life. Under the brilliant leadership of her mentor and actively participating in Company’s events of promoting 1+4, Nancy soon accomplished the assessment of Ruby Distributor successfully. Besides herself, Nancy hoped to help more excellent partners to succeed, therefore, she wanted to expand her business and team more rapidly with different business models and diversified products. Nancy discovered that there are a number of outstanding
NU SKIN products in overseas markets and they are not imported and available for sale in Hong Kong and Macau. Perhaps this could be a huge business opportunity. Nancy therefore convinced her foreign friends to run NU SKIN business together and imported overseas products from overseas markets to Hong Kong and Macau for resale via her foreign friends. When everything was ready, Nancy intended to have the exclusive sale as advertising gimmick to attract more people who are willing to develop NU SKIN business with her, without realizing that her behavior had violated Company’s policies and might also constitute a breach of laws.

 

(Analysis)
According to sub-section 3.11 of Section 3 (Ordering Products or Services) of Chapter 2 of NU SKIN’s Policies and Procedures, and the Distributor Agreement, Distributors may only resell Products in his/her Resident Country. The Products Distributor resell must also be purchased from the Company in his/her Resident Country, and Distributors may not resell Products in his/her Resident Country that Distributors acquire from the Company in a Non-Resident Country. Distributors may only purchase products in a Non-Resident Country for personal use or to demonstrate the Products to potential new Distributors but they cannot resell the Products in a Non-Resident Country. Distributors cannot, either directly or indirectly, sell or distribute any NU SKIN Products in a Non-Resident Country. In addition to the regulations mentioned above, unauthorized importation of NU SKIN products from overseas may violate the laws and regulations of Hong Kong and Macau relating to importation, customs and taxation and the offenders may be imposed fines or need to pay back the tax due.

Abiding by NU SKIN’s Policies and Procedures, the Distributor Agreement and the relevant laws and regulations is the key to success in operating NU SKIN business.
