Preferred Customer Terms and Conditions for Australia & New Zealand
As a Preferred Customer, you will need to follow the Terms and Conditions through all aspects of your membership.
• There is no required minimum order amount when ordering
products directly from Nu Skin Enterprises, its subsidiaries or
affiliates (collectively the “Nu Skin Group”), except when ordering
through the Automatic Delivery Rewards program (ADR).
• All products ordered by the Preferred Customer must be paid in
full before such products are shipped to the addresses (which must
be within Australia or New Zealand) provided by the Preferred
Customer.
• In the case of the product not being defective, you can receive a
90% refund of the price paid at the time of your order on unopened
products in reasonably good condition returned within 12 months
from order date.
• Preferred Customers cannot on sell or otherwise re-supply the
products or services they buy.
• Preferred Customers cannot sponsor other Distributors, Preferred
Customers or Retail Customers.
• Nu Skin Enterprises’ Distributors are not eligible to be Preferred
Customers.
• A Preferred Customer’s account is permanently linked to the
Distributor who referred them to the Preferred Customer program.
This link can only be changed after a period of one month where the
Preferred Customer has no activity on their account.
• The Nu Skin Group’s trade names, trademarks, product names or
logos cannot be used without prior written consent from the Nu
Skin Group.
• A Preferred Customer can become a Nu Skin Enterprises’ Distributor by purchasing a Business Portfolio and submitting the necessary legal documents.
• I agree that I provided consent to the Distributor to discuss the Nu Skin Enterprises products and services with me, and hereby provide an on-going invitation to the Distributor to approach me regarding Nu Skin Enterprises’ products and services in the future until I revoke my invitation in person, by telephone or in writing, including electronic mail.
• I understand and agree that this Preferred Customer Agreement is a renewable agreement, and that I may order Nu Skin Enterprises’ products and services at any time or on a recurring monthly basis, and that this agreement will remain in place and govern the further supply of products and services.
Nu Skin Enterprises reserves the right to:
• Amend any or all of the terms, conditions or features of the
Preferred Customer program, including, but not limited to, the
joining fee, upon 30 days’ notice; and withdraw, cancel, change
or suspend, upon 30 days’ notice, any benefit offered under the
program, or the program itself.
To the maximum extent permitted by law, all representations, and warranties in relation to the Preferred Customer program and the products supplied pursuant to it are expressly excluded, including without limitation, the implied warranties of merchantability and fitness for a particular purpose, provided that where you are a consumer under the Consumer Guarantees Act 1993 or other relevant consumer related legislation and are not acquiring any products under this program for business purposes or with the intent to re-supply them in trade, nothing in this Agreement will affect your rights under that Act.
To the maximum extent permitted by law, the Nu Skin Group disclaims all liability arising out of or in connection with the Preferred Customer program and the products offered for sale through this program
Privacy:
We respect your privacy. Nu Skin Enterprises collects from you and holds certain personal details about you, in order to provide you with the benefits of being a Preferred Customer and communicating with you regarding promotional offers. Referral details are gathered to ensure you are linked to the Distributor who referred you. All information submitted by Preferred Customers will be held by Nu Skin Enterprises in Australia at 2 Eden Park Drive, North Ryde, NSW and in New Zealand at Montgomerie Road, Airport Oaks, Auckland.
You have rights of access to, and correction of, your personal information held by Nu Skin Enterprises. These may be exercised by contacting Nu Skin Enterprises’ Privacy Officer for Australia and New Zealand at PO Box 116, North Ryde BC, NSW, 1670, Australia. Nu Skin Enterprises may disclose your personal information to contracted vendors such as a mailing house for the purpose of mailing only Nu Skin Enterprises literature. Any such vendor would only have access to your personal information for the purposes of the Preferred Customer program.
Except as set out above, Nu Skin Enterprises will not disclose, sell, transfer, assign or rent your customer information to any third party without your permission unless required by law. If you do not wish to provide the mandatory information requested, unfortunately we will be unable to provide you with the privileges of membership.
