Qualification Period:
January 2023 to December 2023
Requirements:
(1) For the qualified account to be rewarded to attend the Leadership Summit, the Brand Affiliate account needs to be paid as Ruby Partner or above for any 4 months and meet a monthly minimum of 6 Building Blocks (3000 GSV) in each of these 4 months during the Qualification Period.
The qualifying account will earn two (2) tickets to Leadership Summit and may choose to bring a second person (the “Second Participant”).
Qualified participants in (1) are referred to as “Qualifiers”.
TERMS AND CONDITIONS
1. Qualifiers acknowledge and agree that their participation in the Leadership Summit constitutes their full and unconditional agreement to and acceptance of the Qualification Criteria and the terms and conditions (collectively, the “Terms and Conditions”) set out below.
2. The meaning of capitalised terms not defined in these Terms and Conditions may be found in your Brand Affiliate Agreement, applicable Sales Performance Plan, or applicable Policies and Procedures (collectively, the “Governing Documents”). For the purposes of these Terms and Conditions, “Nu Skin” refers to Nu Skin Enterprises Australia, Inc., Nu Skin Enterprises New Zealand, Inc. and their affiliated companies.
3. These Terms and Conditions are to be read together with the Governing Documents.
Eligibility
4. Any Brand Affiliate within the Pacific Region (Australia, New Zealand, French Polynesia and New Caledonia) in good standing is eligible to attempt to qualify for the Leadership Summit. A Brand Affiliate who violates the terms and conditions of their Governing Documents or these Terms and Conditions may be deemed ineligible. Eligibility for all Leadership Summit benefits is based on meeting all requirements of the applicable Sales Performance Plan, including all monthly customer sales requirements.
5. Subject to these Terms and Conditions, to be eligible to participate in the Leadership Summit Brand Affiliates are required to meet the requirements as stated above and once qualified must maintain a minimum title of Brand Representative until April 2024.
6. Certified Lines of the Qualifiers who qualify towards the Leadership Summit must be within Pacific Region (Australia, New Zealand, French Polynesia and New Caledonia).
7. Title advancement as a result of roll up will not count toward the qualifications.
8. Any title advancement that is the result of an account merger will not be entitled to participate in the Leadership Summit, i.e. if two (2) accounts merge to create an Executive Brand Partnership, the merged account would not qualify for the Leadership Summit.
Rewards:
9. Qualifiers will be required to make their own flight bookings. Flights to and from the Leadership Summit will be at Qualifiers own expense. However, Nu Skin will allocate a flight subsidy (“Flight Subsidy”) for return economy class flights to the Gold Coast (OOL) for Qualifiers departing from their home city in Perth, Adelaide, New Zealand, New Caledonia and French Polynesia (as stated on their account).
10. Flight Subsidy applies only to the account holder(s). If Qualifiers elect to bring a Second Participant that is not an associate listed on the qualifying account, these flights will be at Qualifier’s own expense. Nu Skin will inform you of the Flight Subsidy when Leadership Summit invitations are sent out to Qualifiers via email.
11. For Qualifiers who receive a Flight Subsidy, upon booking and paying for your flights, please submit the copy of the receipts to Nu Skin and we will reimburse you the actual amount paid, up to the maximum amount of the Flight Subsidy. The reimbursement will be paid into the Qualifier’s next monthly commission. Any airline, location or date changes are at your expense and subject to Nu Skin’s prior written approval. Brand Affiliates may choose to upgrade or redeem any flight by using their personal airports/mileage or cash funds; however, Nu Skin will not reimburse for these upgrades or redemption. Nu Skin will not accept the cost of additional travel insurance purchased by a Brand Affiliate.
12. All receipts must be submitted to the Nu Skin office at your home market no later than 30th June 2024 for entitlement of reimbursement of Flight Subsidy.
13. Hotel accommodation, meals and company-sponsored activities and events are provided by Nu Skin as indicated on the Leadership Summit Registration Form.
14. Return Airport transfers from Gold Coast Airport (OOL) to your hotel are provided by Nu Skin. Please note: Complimentary round-trip airport transfer to and from the hotel in Gold Coast will be available ONLY on the arrival and departure dates listed on your invitation. Any transfers outside of these dates will be the responsibility of the Brand Affiliates at their own cost.
15. Nu Skin will pay for one (1) car parking fee for all local Gold Coast/Brisbane Qualifiers. Qualifiers must advise of parking request at least one (1) week before the event start date.
Matters relating to the Leadership Summit:
16. Nu Skin will be free to determine the maximum Flight Subsidy per ticket. Any additional costs are the Qualifiers’ responsibility and for your own account.
17. Meals, activities, events and other expenses outside of those sponsored by Nu Skin are similarly Qualifiers’ own responsibility and for your own account. Qualifiers may be required to provide your hotel with the details of a designated credit card upon check in, which may be used by the hotel for payment of incidentals outside of those sponsored by Nu Skin.
18. Qualifiers may only attend the Leadership Summit which they have qualified for. Nu Skin reserves the right to refuse any request to attend a future summit, regardless of circumstances.
19. No substitutes or cash equivalents will be awarded. The Leadership Summit is non-transferable. Qualifiers and/or your Second Participant who cancel their participation in the Leadership Summit after official confirmation, or otherwise fail, refuse and/or neglect to attend the Leadership Summit, for any reason whatsoever (an “Absentee”) may incur costs to the Brand Affiliate account. Qualifiers agree and authorise Nu Skin to recover any and all such costs, including but not limited to the Absentee’s accommodation, Nu Skin-sponsored meals, activities and events, by any means which Nu Skin deems appropriate.
20. Travel Insurance is not included in the Leadership Summit. Qualifiers will need to make their own arrangements if needed.
21. To participate in the Leadership Summit, Qualifiers and the Second Participant MUST have their travel visas (if required) three (3) weeks prior to the departure date. Qualifiers and their Second Participants are responsible for applying for their own visas.
22. The value of the Leadership Summit may be considered a benefit in kind by the tax authorities in your market and deemed taxable income earned by you. Nu Skin is legally required to report the total benefit in kind per person to the tax authorities. All taxes are the sole responsibility of the recipient(s). Qualifiers agree that you are responsible to seek advice from an independent tax or legal advisor to determine if participating in the Leadership Summit has any implications for you. Nu Skin will provide the exact value of the Leadership Summit upon request. You accept and agree that Nu Skin will not be responsible for the payment of any taxes, fines or penalties incurred by you as a result of attending the Leadership Summit.
23. Brand Representatives with excessive returns in their organisation may be disqualified. Nu Skin reserves the right, in its sole discretion, to determine what constitutes excessive returns. If there are any excessive returns in the 12 months following the trip of the Leadership Summit that would have affected pin level and qualification for the trip, then the Brand Affiliate agrees to reimburse Nu Skin for the cost of the trip and any other recognition events.
24.To participate in the Leadership Summit, Qualifiers must not be in breach of the Policies & Procedures (see Chapter 2, Section 6.5 of the Policies & Procedures for complete policy). Nu Skin reserves the right to audit and assess the validity of Qualifiers’ Brand Affiliate account and the related sales volume. A Brand Affiliate account that was established in violation of the requirements set forth in the Brand Affiliate Agreement and applicable Sales Performance Plan will be considered invalid and may result in disciplinary action. It is strictly prohibited for Brand Affiliates to use false identification numbers, false names, or false accounts; to buy additional product to maintain or achieve a title; to use any other form of manipulation that violates the terms and conditions of the applicable Sales Performance Plan, or its spirit and intent; or to encourage others to perform any prohibited action. Any indication of manipulation regarding the qualification criteria will disqualify any Qualifiers attempting to benefit from the Leadership Summit. This includes, but is not limited to, buying in volume for qualification purposes using downlines accounts. Nu Skin reserves the right to take any actions provided under the Brand Affiliate Agreement against you, and/or seek to recover any expenditure or other costs associated with your participation in the Leadership Summit, or any other costs incurred by Nu Skin as a result of the manipulation from you, including withholding future sales compensation.
25. Nu Skin has the final decision in the event of any disputes regarding any of the above.
26. Nu Skin reserves the right to interpret the rules of the Leadership Summit.
27. Nu Skin reserves the right to change any of the Terms and Conditions at Nu Skin’s discretion without prior notice to the participants.
28. These Terms and Conditions incorporate the relevant terms and conditions of the Governing Documents and shall be construed in accordance with, and to give effect to, the spirit and intent of the same. Accordingly, these Terms and Conditions adopt the same governing law and dispute resolution provisions of the applicable Governing Documents. Any dispute in respect of these Terms and Conditions or the Leadership Summit shall be resolved in accordance with the dispute resolution provisions of the Governing Documents.
