NU SKIN BETA TESTER AGREEMENT

Congratulations! You have been selected to participate in the Beta Testing Program of Nu Skin International, Inc. (“Nu Skin”), which will allow you to participate in focus groups related to one of our mobile applications (the “App”) and/or to  test the App before it is launched to the general public (“Beta Testing Program”). Please read this Beta Tester Agreement (“Agreement”) carefully before you accept it as it will govern your use of the App and how we will manage your feedback.

 

  1. Use of the App. You are being provided access to the App as a beta tester. When using the App, you must always comply with the App’s Terms and Conditions, which you will have to accept before starting your use of the App. If you do not agree with the App’s Terms and Conditions and/or this Agreement, you will not be able to participate in the Beta Testing Program.

  2. Feedback. As part of the Beta Testing Program, you will be asked to provide Nu Skin with information related to your use of the App. The information you provide to Nu Skin may include suggestions, comments, or other feedback (“Feedback”). Feedback, even if designated as confidential by you, shall not, absent a separate written agreement, create any confidentiality obligation for Nu Skin in regard to such Feedback. All Feedback will be the exclusive property of Nu Skin. To the extent you own any rights in the Feedback, you agree to assign and hereby do assign to Nu Skin all right, title, and interest in and to the Feedback. You agree to perform all acts reasonably requested by us to perfect and enforce such rights.

  3. Voluntary participation. You understand that your participation to the Beta Testing Program is purely voluntary. Since your participation is voluntary, you acknowledge that no compensation should be owed to you for testing the App and/or providing Feedback.

  4. Confidentiality. In principle, you are allowed to share information about the App to the general public. However, if Nu Skin expressly mentions that all or part of the information displayed in the App should be treated as confidential information, you shall not disclose or copy this information until it is released to the general public. Note, any personal data uploaded to the App must be gathered, used, and safeguarded in compliance with all applicable privacy laws.

  5. Termination of your participation. You may terminate your participation in the Beta Testing Program at any time by stopping your use of the App. Nu Skin reserves the right to terminate your participation in the Beta Testing Program and remove your access to the App at any time, and at its own discretion, including, but not limited to, the following situations: (1) termination of the Beta Testing Program, (2) your failure to comply with the App’s Terms and Conditions, this Agreement, and/or the Nu Skin Brand Affiliate Agreement, Sales Compensation Plan, or Policies and Procedures, and (3) your failure to provide Feedback upon Nu Skin’s request.

  6. Privacy. Information collected as part of your participation in the Beta Testing Program, including any personal data that may be included in your Feedback, will be treated in accordance with Nu Skin’s Privacy Notice, which is incorporated herein by reference and which can be viewed on Nu Skin’s website.
