2024 PACIFIC SUCCESS TRIP LISBON (“TRIP”) 2024 - TERMS & CONDITIONS

Eligibility Requirements

 

To qualify for any pin level, you must meet all requirements of the Velocity by Nu Skin™ (as and where applicable), including retail sales. There are no bonuses paid for recruiting. All bonuses and commissions are paid only when qualifying products are shipped or delivered to you. Participants who have satisfied the qualification criteria as set out below between October 2023 – June 2024 (“Qualification Period”) will be eligible to participate in the Trip (“Qualifier”).

 

Nu Skin will pay for Company-sponsored meals, activities, events and accommodation for up to two (2) people per Brand Affiliate Account. Subject to a strict maximum allowance of four (4) people per Brand Affiliate Account, if more than two people from a Qualified Brand Affiliate Account elect to participate, all additional costs for guests and/or children will be at the personal expense of the Qualifier.  

 

A. NEW SUCCESS TRIP QUALIFIERS

Open to all NEW Gold Partner Pin Tile to Team Elite title October 2023 – June 2024 within the Pacific region (Australia, New Zealand, French Polynesia, and New Caledonia).

 

New Gold Partner Pin Title  

In order to qualify for your first Trip, new Gold Partner must complete a four (4) months (consecutive or non-consecutive) maintenance period between October 2023 – June 2024 as the newly advance Pin Title. During these qualifying four (4) months maintenance period the new Gold Partner must accumulate 40,000 Team Sales Volume with a monthly minimum of 10,000 Team Sales Volume (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6). The new Gold Partner must not fall below the title they use to qualify during any time from the 1st month they begin the qualifying four (4) months maintenance period until June 2024. OR accumulate 60,000 TSV between October 2023 – June 2024 and achieve at least 4 months of Gold title. During your qualifying four (4) months maintenance period, a maximum of 3,000 GV per month achieved by your G1 Qualifier may be counted towards your TSV (“Unencumbered Rule”).

 

New Lapis Partner or New Ruby Partner

In order to qualify for your second Trip, new Lapis Partner or new Ruby Partner must complete a four (4) months (consecutive or non-consecutive) maintenance period between October 2023 – June 2024 as the newly advance Pin Title. During these qualifying four (4) months maintenance period the new Lapis Partner or new Ruby Partner must accumulate 50,000 Team Sales Volume with a monthly minimum of 12,500 Team Sales Volume (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6)). The new Lapis Partner or new Ruby Partner must not fall below the title they use to qualify during any time from the 1st month they begin the qualifying four (4) months maintenance period until June 2024. OR accumulate 70,000 TSV between October 2023 – June 2024 and achieve at least 4 months of Lapis/Ruby title. Unencumbered Rule applies. 

 

New Emerald Director

In order to qualify for your third Trip, new Emerald Director must complete a four (4) months (consecutive or non-consecutive) maintenance period between October 2023 – June 2024 as the newly advance Pin Title. During these qualifying four (4) months maintenance period the new Emerald Director must accumulate 80,000 Team Sales Volume with a monthly minimum of 20,000 Team Sales Volume (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6)). The new Emerald Director must not fall below the title they use to qualify during any time from the 1st month they begin the qualifying four (4) months maintenance period until June 2024. OR accumulate 100,000 TSV between October 2023 – June 2024 and achieve at least 4 months of Emerald title. Unencumbered Rule applies.

  

New Diamond Director

In order to qualify for your Trip, new Diamond Director must complete a four (4) months (consecutive or non-consecutive) maintenance period between October 2023 – June 2024 as the newly advance Pin Title. During these qualifying four (4) months maintenance period the new Diamond Director must accumulate 160,000 Team Sales Volume with a monthly minimum of 40,000 Team Sales Volume (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6)). The new Diamond Director must not fall below the title they use to qualify during any time from the 1st month they begin the qualifying four (4) months maintenance period until June 2024.

 

New Blue Diamond Director 

In order to qualify for the Trip, new Blue Diamond Director must complete a four (4) months (consecutive or non-consecutive) maintenance period between October 2023 – June 2024 as the newly advance Pin Title. During these qualifying four (4) months maintenance period the new Blue Diamond Director must accumulate 280,000 Team Sales Volume with a monthly minimum of 70,000 Team Sales Volume (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6)). The new Blue Diamond Director must not fall below the title they use to qualify during any time from the 1st month they begin the qualifying four (4) months maintenance period until June 2024. 

 

New Team Elite

In order to qualify for the Trip, new Team Elite must complete a four (4) months (consecutive or non-consecutive) maintenance period between October 2023 – June 2024 as the newly advance Pin Title. During these qualifying four (4) months maintenance period the new Team Elite must accumulate 440,000 Team Sales Volume with a monthly minimum of 110,000 Team Sales Volume (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6)). The new Team Elite must not fall below the title they use to qualify during any time from the 1st month they begin the qualifying four (4) months maintenance period until June 2024. 

 

Minimum Building Blocks (Group Sales Volume) during qualification

During these qualifying four (4) months maintenance period the new Gold Partner through Team Elite must maintain a minimum of 4 building blocks (2000GSV) every month on their own account and each of their first generation (G1) Brand Representative must maintain a minimum of 4 building blocks (2000GSV) every month. If one of their first generation (G1) Brand Representative do not have a minimum of 4 building blocks (2000 GSV) in a given month within the qualifying four (4) months maintenance period, they need 1 downline Brand Representative with 4 building blocks (2000 GSV) for that month in their team to be counted for pin title qualification.

  

Multiple pin title advancements during 1 success trip qualification period:

If you advance more than one (1) pin title during the Trip Qualification Period, it will be counted for future success trips. You simply need to meet the qualification criteria for the pin title used to qualify for this Trip, and maintain your highest pin title and meet the qualification criteria for the subsequent trip(s) as if you had advanced to your highest pin title. For example, if you advance initially as Ruby Partner and subsequently as Emerald Director between October 2023 – June 2024, you will earn one (1) trip as Ruby Partner and one (1) trip as Emerald Director if you meet the qualification criteria for New Ruby Partner for this Trip, and maintain Emerald Director and meet the qualification criteria applicable to New Emerald Director for the future success trip. We are recognising the fast growth.

Early Qualification:

 

We are counting September 2023 as your first month to potentially qualify if you did not use September 2023 to qualify for the previous success trip.

 

B. PREVIOUS SUCCESS TRIP QUALIFIERS (EVER BEEN)

Ever been Gold Partner through Team Elite may also participate in the Trip by advancing to a higher pin title compared to the pin title of the previous Trip they qualified for as detailed below:

You must complete a four (4) months (consecutive or non-consecutive) maintenance period between October 2023 – June 2024 as the newly advance Pin Title.

·         If you have been to a success trip before as a Gold Partner, you will need to qualify as a new Lapis Partner or Ruby Partner as described above.

·         If you have been to a success trip before as a Lapis Partner or Ruby Partner, you will need to qualify as a new Emerald Director as described above.

·         If you have been to a success trip before as an Emerald Director, you will need to qualify as a new Diamond Director or grow your Team Sales volume (TSV) at the time of your last success trip qualification by 40% (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6).

·         If you have been to a success trip before as a Diamond Director, you will need to qualify as a new Blue Diamond Director or grow your Team Sales volume (TSV) at the time of your last success trip qualification by 30% (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6).

·         If you have been to a success trip before as a Blue Diamond Director, you will need to qualify as a new Team Elite or grow your Team Sales volume (TSV) at the time of your last success trip qualification by 20% (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6)). 

·         If you have been to a success trip before as a Team Elite, you will need to qualify as a Team Elite and grow your Team Sales volume (TSV) at the time of your last success trip qualification by 10% (TSV = your Group, plus all Groups on which you are eligible to be paid a Leading Bonus (G1, up to G6) or have 5 unencumbered qualifiers to the success trip in your G1-G6.

 

Maintenance title required after qualification

Starting from 2021, maintaining the minimum pin title that you used during the qualification is required for all success trip qualifiers after the last qualifying month is completed and until the registration for the success trip opens. If the Brand Affiliate account fails to maintain the required title, they will not be eligible to attend the Success Trip, even if the four (4) qualifying months have been achieved.

 

LISBON SUCCESS TRIP - GENERAL TERMS AND CONDITIONS

 

1.      You acknowledge and agree that your participation in the Lisbon Success Trip 2024 (the “Trip”) constitutes your full and unconditional agreement to and acceptance of the qualification criteria and these terms and conditions, including the Additional Rules appended below (collectively, the “Terms and Conditions”).

2.     The meaning of capitalised terms not defined in these Terms and Conditions may be found in your Brand Affiliate Agreement, applicable Sales Performance Plan, or applicable Policies and Procedures (collectively, the “Governing Documents”). For the purposes of these Terms and Conditions, “Company” refers to Nu Skin Enterprises Australia, Inc., Nu Skin Enterprises New Zealand, Inc. (collectively “Nu Skin Pacific”), and their affiliates.

3.     These Terms and Conditions are to be read together with the Governing Documents, the Trip itinerary and any other Trip rules which Nu Skin Pacific may communicate from time to time.

4.     A Brand Affiliate who violates the terms and conditions of their Governing Documents or these Terms and Conditions may be deemed ineligible. Eligibility for all Success Trip benefits is based on meeting all requirements of the applicable Sales Performance Plan, including all monthly customer sales requirements.

 

Eligibility and Qualification

5.     You must be a Brand Representative and above registered with Nu Skin Pacific.

6.     Subject to these Terms and Conditions, Brand Representatives who satisfy the qualification criteria during the relevant Qualification Period will be eligible to participate in the Trip (each, a “Qualifier”). A Qualifier’s Brand Affiliate Account shall be referred to in these Terms and Conditions as a “Qualified Brand Affiliate Account”.

7.     Pin Title advancement as a result of roll up will not count toward the qualifications.

8.     Any pin title advancement that is the result of an account merger will disqualify you from that particular Trip, i.e. if 2 accounts merge to create a Gold Partner, the merged account would be disqualified from the new Gold Partner advancements but could qualify for the Trip as a new Ruby Partner, new Emerald Director, new Diamond Director and Blue Diamond Director advancements subject to the Terms and Conditions of the Trip.

 

Reward details

 

9.     The Company will pay for all Company-sponsored meals, activities, events and accommodation for up to two (2) people per Qualified Brand Affiliate Account as specified in the “Package Includes” section of the Additional Rules. Unless otherwise stated, both participants must be Brand Affiliates who are named on the Qualified Brand Affiliate Account during or prior to the Qualification Period.

10.   Subject to the maximum number of participants per Qualified Brand Affiliate Account set out in the Additional Rules, if more than two people from a Qualified Brand Affiliate Account elect to participate, all additional costs will be at the personal expense of the Qualifier.

11.    Eligibility of children, immediate family members and additional participants (hereafter referred to as a “Guest”) to attend the trip may vary from year to year depending on destination and subject to the Additional Rules. Where there is only one person named in a Qualified Brand Affiliate Account, a family member of the Qualifier (who must not be a Brand Affiliate) may attend as the second participant of the Qualified Brand Affiliate Account (the “Second Attendee”). A “family member” is defined as an immediate family member, i.e. spouse, father, mother, son, daughter, brother or sister.  In such case, the terms and conditions set out herein (where applicable) shall also apply to the immediate family member concerned.

 

General Terms and Conditions

 

12.   Brand Representatives with excessive returns of products in their team sales volume (“TSV”) may be disqualified for the Trip. Nu Skin Pacific reserves the right, in its sole discretion, to determine what constitutes excessive returns. If there are any excessive returns in the twelve (12) months following the Trip that would have affected pin level and qualification for the Trip, then the Brand Representative/Brand Affiliate agrees to reimburse Nu Skin Pacific for the cost of the Trip and any other recognition events, including but not limited to air fare, hotel accommodation, meals, transportation costs, local group tours and other miscellaneous fees.

13.   Brand Affiliates must not be in breach of Section 6.5, Chapter 2 of the Policies & Procedures. Any indication of manipulation regarding the qualification criteria will disqualify any Brand Representative and above attempting to benefit from the action. This includes but is not limited to buying in volume for qualification purposes on down line accounts.

14.   No substitutes or cash equivalents will be awarded. The Trip is non-transferable. Trip cancellation by Qualifiers, Second Attendees and/or their Guests after official confirmation may incur costs to the Qualified Brand Affiliate Account.

15.   Nu Skin Pacific reserves the right to amend any of the Term and Conditions herein without prior notice.

16.   Nu Skin Pacific has the final decision on the interpretation of the Terms and Conditions and any other rules of the Trip and has absolute discretion to make the final decision on the qualification of the Trip.

17.   Nu Skin Pacific has the final decision in the event of any disputes regarding any of the Terms and Conditions and Additional Rules.

18.   These Terms and Conditions incorporate the relevant terms and conditions of the Governing Documents shall be construed in accordance with, and to give effect to, the spirit and intent of the same. Accordingly, these Terms and Conditions adopt the same governing law and dispute resolution provisions of the applicable Governing Documents. 

 

ADDITIONAL RULES:

 

1.      Only new or ever been Qualifiers (Brand Representative through Team Elites) from markets within the Pacific Region (Australia, New Zealand, French Polynesia and New Caledonia) will be eligible to participate in the Trip.

2.     To be eligible to participate in Trip, G1 Brand Representatives of Qualifiers meeting the qualification criteria have to be within the Pacific Region of Nu Skin (Australia, New Zealand, French Polynesia and New Caledonia). At least 75% of the TSV of the Qualifier must come from the Pacific Region.

3.     Nu Skin Pacific will allocate a flight allowance for two (2) return economy class flights to Lisbon Humberto Delgado Airport (LIS), based on quotes from Nu Skin Pacific’s choice of airline for arrival and departure on the dates of the Trip, from the closest capital city airport from the Qualifier’s mailing address registered with Nu Skin (“Flight Allowance”). Nu Skin Pacific will inform the Qualifiers of the amount of Flight Allowance at the time qualification is met and Qualifiers will be required to make their own flight bookings for themselves and their Second Attendee. Upon booking and paying for these flights, the Qualifier shall submit a copy of the receipts to Nu Skin Pacific and Nu Skin Pacific will reimburse the Qualifier the actual amount paid, up to the maximum amount of the Flight Allowance. The reimbursement will be paid together with the Qualifier’s monthly commission in the following month after Nu Skin Pacific receives and approves the copy of the receipt.  The reimbursement is limited to the amount paid for the original booking, and any subsequent add-ons, airline, location or date changes resulting in price increases shall be at the Qualifier’s expense. Further, Brand Affiliates may choose to upgrade or redeem any flight by using their personal airports/mileage or cash funds; however, Nu Skin will not reimburse for these upgrades or redemption.

4.     If for whatever reason the Qualifier(s) and/or their Second Attendee (where applicable) did not attend the Trip (each, an “Absentee”), the Qualifier agrees and hereby irrevocably authorises Nu Skin Pacific to recoup the Flight Allowance (if already paid), hotel accommodation, local airport transfers and/or such other costs and expenses incurred by the Company in relation to the Absentee’s participation in the Trip by deducting commission from the Qualifier’s Brand Representative account any time, or by issuing a debit note to the Qualifier for his/her settlement, or by any other means which Nu Skin deems appropriate.

5.     To participate in the Trip, all Qualifiers, Second Attendees and Guests MUST have their travel visas (if required) three (3) weeks prior to the departure. Qualifiers, Second Attendees and Guests are responsible for obtaining their own visas and all expenses associated with obtaining the required travel documents prior to the Trip.

6.     Guests must not be a Brand Affiliate of Nu Skin. The total number of Qualifier(s), Second Attendee and Guests from a Qualified Brand Affiliate Account must not exceed a maximum of four (4) persons. If more than two people from a Qualified Brand Affiliate Account elect to participate, all additional costs incurred for Guests will be a personal expense of the Qualifier. Confirmation of the Qualifier’s Second Attendee’s (where applicable) and Guest’s participation MUST BE made in writing to the Company no less than six (6) weeks prior to the commencement of the Trip.  Full payment for Guests MUST BE made no less than two (2) weeks prior to the commencement of the Trip. If written confirmation and payment is not made by this time, then Nu Skin would cancel all prior reservations made for the Qualifier’s Guests and Nu Skin will not entertain any requests for extension for payment. Any late or non-payment for Guests’ additional costs will be deemed a Trip cancellation by Guests which may incur costs to the Qualified Brand Affiliate Account.

7.     Nu Skin Pacific will pay for the costs of airfare, hotel, Company-organised group ground transportation, some meals and some amenities for up to two (2) persons per Qualified Brand Affiliate Account, as indicated on the itinerary and set out in the “Package Includes” section below. Any additional costs will be the responsibility of the Qualifiers. 

8.     The Company reserves the right to withhold final approval on Qualifiers’ participation in the Trip pending verification of compliance of the Terms and Conditions of Trip. Participants must be Brand Representatives in good standing with Nu Skin Pacific during the qualification period. Brand Representative found in non-compliance with the Governing Documents during the qualification period and any time prior to the Trip may be disqualified from participating.

 

PACKAGE INCLUDES:

1.      A five (5) day/ four (4) night* trip for two (2) persons per Qualified Brand Affiliate Account. *Subject to change.

2.     Reimbursement of roundtrip airfare to Lisbon (subject to the Flight Allowance) and ground transportation to and from hotel, as well as all Company-organised activities for a maximum of two persons per Qualified Brand Affiliate Account as indicated on the itinerary. Please note - complimentary round-trip transportation to and from hotel in Lisbon will be available ONLY during the dates and/or times provided. Any transfers outside of these dates or times will be the responsibility of the Qualifier at their own cost.

 

3.     Additional rooms may be arranged based on availability and at the expense of the Qualifier.

4.     All meals indicated on the itinerary. 

5.     All baggage handling if provided at the hotel.

6.     All hotel taxes and gratuities.

7.     Group activities as indicated on itinerary.

 

WHAT’S NOT INCLUDED THAT BRAND REPRESENTATIVE WILL HAVE TO PAY FOR?

1.      Any “free-time” activities or “optional” suggestions or tours, phone calls, laundry and any other hotel incidentals.

2.     Transportation to and from any events that Qualifiers choose to participate in other than what is included on the itinerary. Nu Skin Pacific are not responsible for arranging transportation or transporting Qualifiers, Second Attendee and Guests to any outside events, including fly-ins.

3.     Transportation to and from hotel if arrival and/or departure dates/times are different from those indicated on itinerary. 

4.     Meals and Activities not shown on itinerary or indicated “at leisure”.

5.     Any other expenses not specifically mentioned herein are not included.

6.     Applicable state, federal and local taxes.

7.     Travel Insurance is not included in the Trip. Qualifiers, Second Attendee and Guests are responsible for obtaining their own travel insurance and ensuring this meets their own individual needs.

8.     Qualifiers, Second Attendee and Guests are responsible for obtaining their own travel documents including passports, visas etc. and all expenses associated with obtaining the required travel documents prior to the trip.

9.     Qualifiers are required to provide a valid credit card at time of check-in to pay for additional room charges, optional activities and their own incidental costs at the time of check-out.

10.   If more than two people from a Qualified Brand Affiliate Account elect to participate, all additional costs for Guests will be a personal expense of the Qualifier – including but not limited to flights, in room costs, extra beds, special requests etc for the Guests.

  

OTHER INFORMATION:

1.      If you cannot travel on dates specified, your participation in the Trip will be forfeited. You may only attend the specific Trip you have qualified for, and the Company will not honour any request to attend a future trip, regardless of circumstance.

2.     Taxes – You will be responsible for applicable federal, state and local taxes, fees and any additional charges.

3.     Cancellation Policy – Once you have registered for the trip and airfare is booked, any cancellations could forfeit your chance to participate in any future Trip experience.

4.     Cancellation of Activity – You may not change your selection of activity. If you choose to participate in another activity, you will be responsible for the full expense of that activity regardless of whether or not you participated in the originally selected activity.

5.     Anyone who decides to participate in a Trip activity will be required to sign a waiver as well as a personal data consent form. You may not participate in the activity until Nu Skin Pacific’s representative has received signed waivers/agreements from all attendees.

6.     You hereby agree, by accepting this Trip, to release Nu Skin Pacific and its parent, affiliated and subsidiary companies and their officers, directors, and employees from all liabilities of every kind, including personal injury, death and property damage arising from the acceptance of the Trip and participation in it.

7.     You hereby agree, by accepting this Trip, to give Nu Skin Pacific the absolute right and permission, with respect to the photographs, film and/or tape that it has taken of you, your Second Attendee and your Guest(s) on the Trip. In addition, you, your Second Attendee and your Guest(s) agree to give the Company the right to use, re-use, publish and re-publish (with no limitations on times used) the same in whole or part, with intentional or unintentional alterations, without limitations as to optical or audio effect, individually or in conjunction with other photographs or images, in any medium and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade.
