READY.SET.GLOW! CONTEST TERMS AND CONDITIONS



     
  Nu Skin Enterprises Philippines LLC (“Nu Skin”) is running a ‘READY.SET.GLOW!‘ CONTEST’ (the “Contest”) commencing from 15th August 2024 to 30th September 2024 ("ContestPeriod”).  

For the purposes of these terms and conditions, “Company” refers to Nu Skin, its parent company, subsidiaries and affiliates. These terms and conditions are to be read by all individuals who participate in the Contest.

Where you are a Brand Affiliate, these terms and conditions incorporate your Brand Affiliate Agreement and International Sponsor Agreement and the Resident Market Product Purchase Agreement, the Policies and Procedures, and the Nu Skin Sales Performance Plan (collectively, the “BA Agreements”). 

Terms and Conditions

The following sets out the terms and conditions applicable to the Contest.

You acknowledge and agree that your participation in this Contest constitutes your full and unconditional agreement to and acceptance of these terms and conditions. You may withdraw from this Contest by notifying us in writing at any time. 

Eligibility

  1. This Contest is open to all individuals who are:
    1. citizens or legal residents of Philippines (“Nu Skin PH”); and 
    2. aged at or above 18 years of age or the age of majority in their location, whichever is greater. 

      (“Eligible Participants”, “you” or “your”). 

  2. Employees or immediate relatives of an employee of the Company or any entity or person involved in the setting up of the Contest are not eligible to participate in this Contest.

Mechanics

  1. Eligible Participants who meet all the terms and conditions of this Contest during the Contest Period may be eligible to receive a Prize (defined below) under this READY.SET.GLOW! CONTEST.  

  2. During the Contest Period, you will stand a chance to win a Prize when you share your experience with your ageLOC WellSpa iO on your public Facebook/Instagram profile in accordance with the steps below:

    Step 1:     Take a screenshot of your highest Day Streak award badge on Nu Skin Vera app, and take a selfie of yourself with your ageLOC WellSpa iO device; 

    Step 2:Share the selfie featuring your ageLOC WellSpa iO and the screenshot of your badge on Facebook/Instagram, and add a caption to your post letting us know how ageLOC WellSpa iO has been working for you;

    Step 3: Hashtag #WellnessNBeauty, #WellSpaiO, #ReadyForAnything, #NuSkinPH

    Step 4: Set your profile to public and share your post link to Nu Skin PH campaign post by adding a comment to the comment section. 

You must ensure that all captions and photos posted comply strictly with the Nu Skin Product Testimonial Guidelines of your Nu Skin Market, and any claims about ageLOC WellSpa iO must be consistent with the ageLOC WellSpa iO Product Information Page of your Nu Skin Market. 

Posts which do not comply with the Product Testimonial Guidelines of the ageLOC WellSpa iO Product Information Page of your Nu Skin Market will be disqualified, and you will be required to remove such posts from circulation. 

  1. Eligible Participants who successfully complete the steps mentioned above will stand a chance to win one (1) Liquid Body Lufra and (1) Epoch Polishing Bar (the “Prize”). Every post which fulfils the steps mentioned above will give you one (1) chance to win a Prize, but you may only win a maximum of one (1) Prize under this Contest.

  2. The top twenty (20) Eligible Participants with the most creative Facebook/Instagram posts, as solely determined by Nu Skin, will be selected as winners of the Prizes (“Winners”).

  3. Nu Skin will announce the names of Winners on Nu Skin’s localFacebook/Instagram page within five (5) working days of the end of the Contest (the “Announcement”). Winners must claim their Prize via private message to Nu Skin with their winning Facebook/Instagram profile account within seven (7) calendar days of the Announcement, failing which such Prize will be forfeited. Nu Skin reserves the right, in its sole discretion, to dispose of forfeited Prizes in any manner it deems fit.
  1. A Winner’s entitlement to the Prize is based on the selection criteria solely determined by Nu Skin.

  2. The Prizes are available only while stocks last, and Nu Skin reserves the right to replace or substitute a Prize with another product of equivalent value without prior notice.

  3. Any breach of any terms and conditions of this Contest or the Product Testimonial Guidelines of your Nu Skin Market can result in you being disqualified from taking part in the Contest. In the event that you are subsequently disqualified or deemed ineligible for any reason, Nu Skin reserves the right to claim the value of any Prize received by you in any manner that Nu Skin deems fit.

  4. The above is without prejudice to the Company’s right to audit the account of any Brand Affiliate and take any other actions in connection with the breach of the terms and conditions of this Contest or the BA Agreements. 

General Terms and Conditions

  1. Eligible Participants acknowledge that this Contest is in no way sponsored, endorsed, administered by or associated with Meta, and agree to fully release and hold Meta harmless from liability. 

  2. By participating in this Contest, you consent to the Company’s collection, use and disclosure of your personal data with us, including your name, email address, and photographs, for the purposes of administering and promoting this Contest. Such purposes include the advertising, marketing, and promotion of this Contest to the public and the distribution of the Prize. You further consent to the Company reposting any or all of your photos or posts on the Company’s social media or other platforms without any prior notice.

  3. You also agree that: 
    1. You have read, understood and agreed to be bound by all the terms and conditions of this Contest; 
    2. You will comply strictly with the Nu Skin Product Testimonial Guidelines for all postings relating to the use of the Company’s products; and
    3. You are responsible to access Nu Skin’s website at www.nuskin.com at regular time intervals to view these terms and conditions and to keep yourself updated on any changes, amendments or variations to the Contest rules or these terms and conditions. 

  4. In respect of the Prize, you agree that:  
    1. The Prize is non-transferable and non-redeemable for cash; 
    2. You are personally and solely responsible for any expenses or taxes incurred or which may be incidental to receiving and winning the Prize; 
    3. The Prize does not carry Sales Volume, Personal Sales Volume and/or Commissionable Sales Volume; 
    4. Nu Skin has the absolute discretion to change or substitute the Prize with other items of equivalent value without prior notice; and  
    5. The Prize is not refundable or exchangeable for any reason except for product defect.  

  5. Where you are a Brand Affiliate, you must be in good standing in order to participate in this Contest. If you violate any of the BA Agreements or these terms and conditions, you may be deemed ineligible to participate in this Contest. Moreover, the Company may, at its absolute discretion, withhold all or any benefits of this Contest, seek recovery of any Prize claimed by you (or the equivalent value thereof) in any manner that the Company deems fit, take any actions provided under the BA Agreements, and/or seek to recover any expenditures or other costs associated with the Contest or any other costs incurred by the Company as a result of your violation, including recouping sales compensation paid and withholding future sales compensation.

  6. It shall be in Nu Skin’s absolute discretion and Nu Skin has the unfettered right to do all things it deems fit in respect of the Contest, including but not limited to the determination and/or performance of the following: 

    1. Determine the qualification of Eligible Participants to participate in this Contest; 
    2. Change, amend or vary the Contest rules or the terms and conditions in any way which Nu Skin deems fit, without notice to you; 
    3. Disqualifying you from taking part in the Contest or forfeiting the Prize for any reasons whatsoever; and  
    4. Terminating or suspending this Contest at Nu Skin’s absolute discretion, without any prior notice. Such termination or suspension shall not entitle you to any claim or compensation against the Company for any and all losses or damage suffered or incurred as a direct or indirect result of the act of termination or suspension. 

  7. Nu Skin’s decisions on all matters relating to or in connection with this Contest are final, conclusive, and binding on all affected Eligible Participants, and Nu Skin is not bound to give any reasons for its determination in relation to any matters relating to or in connection with this Contest. No further enquiries, correspondence and/or appeal, whether written or verbal, to dispute Nu Skin’s decision shall be entertained.

  8. To the fullest extent of applicable law, Eligible Participants accept that they participate in this Contest at their own risk. Nu Skin shall not, in any way, be responsible for any injury, loss or damage suffered as a result of or in connection with the Contest and/or the Prize however arising, including but not limited to fulfilment of the Prize, or any breakdown or malfunction of any computer system or equipment. 

  9. Should any part of these terms and conditions be void or unenforceable for any reason, the void or unenforceable term and condition, or any part thereof, shall be severed and deleted. The rest of these rules or terms and conditions shall not be affected and shall continue in full force and effect as if the void or unenforceable term and condition, or any part thereof, had never been contained herein. 

  10. Where you are a Brand Affiliate, this Contest adopts the same governing law and dispute resolution provisions set out in the BA Agreements. Where you are not a Brand Affiliate, these terms and conditions shall be governed by and construed in accordance with the laws of your Nu Skin Market, and the Courts of your Nu Skin Market shall have exclusive jurisdiction over any dispute arising out of, or in connection with, your participation in this Contest.
